A month ago, I noted that Ted Rall was probably violating PayPal’s rules on selling something he didn’t have in hand. He was soliciting funds for a lawsuit that may or may not have come to fruition. See Talentless Hack Sues Coulter.

Seems that Michelle Malkin might want to elevate this to those who can flood PayPal’s rules committee. Let’s look at PayPal’s Acceptable Use Policy-Pre-Selling Products Policy:

Pre-Selling Products Policy
You may not use PayPal to sell “pre-sale” items. Pre-sale items are items advertised for sale before the seller has control or possession of the items. These generally consist of items that are sold prior to the item’s availability to the general public, or that are sold by the seller with the intention of using the payment to go out and purchase the item being sold.

PayPal does permit pre-sales on a limited basis, as long as the seller guarantees and reasonably expects that the item will be shipped within 20 days from the date of purchase, and that he clearly inform the buyer that the item is a pre-sale item.

Such a policy ensures that buyers can pay for an item and still have the option to use PayPal’s Buyer Complaint process in the event there is a problem with the transaction.

Does soliciting funds before the lawsuit has even been launched constitute “with the intention of using the payment to go out and purchase the item being sold”??? Seems so to me! Now had Ted already paid for the lawsuit and then asked for donations, this paragraph of PayPal’s policy might not have been breached.

I hope Michelle will modify her post TED RALL’S PLEDGE DRIVE accordingly.

Accompanying the meat are a patriotic bear, my stogie-loving mascot and my St. Rachel of IHOP coffee mug. Above is my Caterpiller helmet. Why the CAT stuff? Follow-up to my earlier Does Totalling Your Car Entitle Me To Blog Less Often? Aaron’s Car Wreck Tonight — Part I.

My car was totalled. Liability assigned 100% to the other driver. I get to drive a rental for a couple of weeks until the insurance company coughs up a check.

The value of cars in LA is slightly higher than Blue Book because of the weather, no salt on the roads, etc..

The car looked salvagable from the outside but the adjuster said that when my car hit the curb, the cast iron frame was twisted.

You will NOT get me into a little car with my kids. The last accident I was in, 14 years ago, was in a 1978 Chevy Caprice when I was broadsided by a tow truck towing a Mercedes that didn’t stop at a 4-way stop. The frame on that police-style car absorbed most of the impact and we walked away sore but alive.

I’ll be saying a blessing tomorrow morning in synagogue for surviving a dangerous situation.

No explanation. Just a form letter straight out of a modern version of Kafka’s The Trial that goes something like this:

    You just did something that re-curdled our tofu.

    In retaliation, we’re deleting products of yours and not even bothering to tell you which, so you have to waste time hunting for the items and THEN guessing why we censored you. Ha ha ha.

    Of course, we typically allow other more egregious violations of our own rules slip through… when we agree with the politics. But you can’t prove that. Ha ha ha.

Drudge is quoting a Nielsen Bookscan report that Markos “Screw Them” Moulitsas Zuniga, the “progressive” thought leader whose web site gets a reported half million visits per day, has sold a whopping 253 copies of his book Crashing the Gate.
